BURGLARY § 13-1506/ 1507/1508

In Arizona, there are three different degrees of burglary classifications. Burglary in the third degree is a Class 4 Felony and occurs when one enters or remains unlawfully in a non-residential structure or in a fenced commercial or residential yard with the intent to commit any theft or any other felony therein.

Second degree burglary is a Class 3 Felony when one enters or amends in or on a residential structure with the intent to commit any theft or any felony therein.

If a defendant or an accomplice commits burglary when in possession of a deadly weapon, a dangerous instrument or explosives, then the defendant faces a Class 2 Felony if the burglary was committed in a residence.
